Can you get a HELOC if your house is in an LLC?

Most HELOC programs, including business purpose HELOCs, need the home titled in your personal name. Here is how the quit-claim deed works and how to do it without stalling your file.

Usually not while it stays in the LLC. HELOC programs — including the business purpose HELOC Capova Capital arranges — need the home titled to you as a person. The fix is a quit-claim deed that moves the title from the LLC into your personal name before the loan funds. Done before you apply, it is a short step. Done mid-file, it is the most common cause of delay.

Why the lender needs personal title

The line is underwritten on you: your credit, your verified income, your debt-to-income. The lender needs the person it underwrote to be the person who owns the collateral, so the lien is enforceable and the title review is clean.

How the quit-claim deed works

  1. 01The LLC, signing through its authorized member, deeds the property to you personally.
  2. 02The deed is notarized and recorded with the county.
  3. 03Title now shows you as owner, and the HELOC can record its lien behind any existing mortgage.

Before you deed anything, check with your attorney or accountant about any tax, insurance, liability, or existing-mortgage consequences of moving the property out of the LLC. Tell us up front so the timing lines up with your file.

What about a trust?

A home held in a trust may be workable depending on the trust. Ask before applying rather than discovering it at title review.

Common questions

Can I get a HELOC on a property owned by my LLC?
Most HELOC programs, including business purpose HELOCs, require the home to be titled in your personal name. A quit-claim deed from the LLC to you, recorded before closing, resolves it.
Does a business HELOC have to be in my personal name if the money goes to my business?
Yes. The funds go to your business bank account and must be used for the business, but the home securing the line must be titled to you personally, because you are the borrower being underwritten.
Is a home in a trust eligible for a business HELOC?
It may be, depending on the trust. Ask Capova Capital's desk before you apply so it does not surface at title review.
